The
Act should make provisions for the setting up of
a two tier policing Service in Ireland.

The
Act should State that the Garda Siochana is under
the control of Dail Eireann and the four Provincial
Police Services are each under the control of the
appropriate House of Representatives.
The Act should make provision for the setting of
a department of policing studies in the universities
where members of the Garda Siochana are educated.
The Act should recommend that each member of the
Garda Siochana be fluent in Irish. In the case of
members of Provincial Police Service, under the
Act these should be trained and educated in a Provincial
Police academy.
The Act should State that in the enforcement of
the Law, the Police Service should be constitutionally
neutral.
However under freedom of mind, freedom of speech
and freedom of expression the Act should state that
the Police Services, both National and Provincial
are free to comment upon, issue statements or criticise
the Laws of the State both National and Provincial.
The Act should permit the appointment of a National
Ombudsman and an Ombudsman for each of the four
Provincial Policing Services.
The Act should State that the person ultimately
responsible for Police behaviour in enforcing the
Law is the Minister of Justice in Dail Eireann in
the case of the Garda Siochana, and the Provincial
Representative for Justice in each of the Policing
Services in the Four Provinces.
The Act should confer upon the police service both
National and Provincial the Crown Irish special
right of access to Irish territory in all its aspects,
to every nook and cranny of the environment, to
all institutions organisations, professions and
to all groups either public or private. To all buildings
and structures and dwellings unhindered.
The Act should stipulate as necessary that the Police
Service must produce a search warrant when entering
a private dwelling.
The Act should empower the Police Service both National
and Provincial to use firm but reasonable Force
in enforcing the Law.
The Act should stipulate as necessary that members
of the Police Service both National and Provincial
be trained in the use of fire arms.
In times of civil disorder and riot which is a threat
to life and property, the Act empowers the Taoiseach
to call out the armed Police Force both Nationally
and Provincially and quell the civil disturbance
or riot with the use of firearms. The Act should
state that unless the Police Services are faced
with an armed individual or armed gang members of
the Police Services both Nationally and Provincially
must be unarmed.
The Act should stipulate as necessary that individuals
and the communities give full co-operation with
and information to the National Police Services
both National and Provincial.
The Act should expect that the National and Provincial
Police Services will liaise closely with one another.
